Contests are different from sweepstakes in several ways. While sweepstakes are games of chance, contests require a level of skill or uniqueness from the entrant. Additionally, whereas “no purchase necessary” is a standard mandate for sweepstakes, contests may require a purchase for entry, and companies can create a database of confirmed users.

The sponsor of a user-generated contest must have ironclad rules in place to protect itself against copyright infringement on the part of the entrants. The rules must also clearly state that the sponsor has the rights to all submitted content for use in future marketing efforts.
